Today, in the presence of the representative of the proposer, the Security and Defence Committee considered the Proposal for the Law on Amendments to the Law on Defence.

During the debate, the Committee members paid special attention to the proposed amendments to the Law, which entail the following: harmonising the current Law with the strategic documents in the field of security and defence; specifying the responsibilities of the Government of Montenegro, the Defence and Security Council, and the Ministry of Defence; development of tasks of the intelligence-security Directorate; regulating the control of military air traffic and responsibilities for making the decision on the use of force in air space of Montenegro against civil or military aircrafts, as well as regulating the tasks of codification and quality assurance in the field of defence.

On this occasion the Committee highlighted that, in part of provisions relating to the rights and duties of those responsible for defence preparations, the Proposal for the Law defines that military responsibility of Montenegrin citizens shall be implemented not only in the conditions of the state of war or the state of emergency, but also in peace, which was not the case in the text of the current Law.

The Committee members noted that the adoption of the said regulation, among other things, was aimed at additionally specifying the responsibilities of the President of Montenegro, bearing in mind that the proposed provisions determine that the Parliament of Montenegro shall decide on submitting a request to the North Atlantic Alliance for invoking Article 5 of the North Atlantic Treaty, as well as that by this decision the Parliament shall decide on the entry of representatives of militaries of the North Atlantic Alliance into the territory of Montenegro for providing defence assistance.

Based on the above, the Committee decided with a majority of votes to propose to the Parliament to adopt the Proposal for the Law on Amendments to the Law on Defence.
