The Proposal prescribes conditions that must be fulfilled in order to be possible to enter into partnership, the procedure for entering into partnership and termination thereof, regulated register of life partnerships, legal effects of partnership, regulated partner’s child support. Furthermore, the ownership relations of partners were regulated in detail and it was prescribed that they have the right to inherit each other. The Proposal also regulates the tax status of partners with regard to exemption from tax on immovable property sales in the case of immovable property was sold between the partners during their life together. With regard to rights and obligations in the health care system, as well as the social and child protection systems, same-sex partners are equal with spouses, and their rights and obligations are also regulated, namely the right to visit during the prison sentence. Most provisions of this proposal for law relates to a series of rights and obligations that are implied for heterosexual partners and which are a part of our daily lives.
Following the discussion, the Committee supported the Proposal for the Law on Same-sex Life Partnership with a majority of votes of members who were present and proposed to the Parliament to adopt all three amendments of the Committee which were accepted by the representative of the proposer.
Furthermore, the Committee members adopted four information papers on the Committee’s activities implemented in January and February 2019.
At the meeting held today, the Committee members learned about the Official Letter of the Council for Civilian Control of Police Operations, namely the Council’s comment on the latest report for Montenegro by the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT).
Under the item of the agenda “current issues”, the Committee members were informed about the Official Letter by the Protector of Human Rights and Freedoms of Montenegro giving information on the outcome of the procedure upon the Application of Mr Milutin Pavićević and Mr Željko Gagula and Conclusion by the Council for Civilian Control of Police Operations adopted regarding the consideration of the Initiative by the NGO “Alternative” with headquarters in Pljevlja.
